Warranty

“Warranty Term Nolah Original Mattress. The Nolah 10” Original Mattress is covered by a 15-year limited warranty (“Limited Warranty”)  for the original purchaser of the Nolah Original Mattress for defective products

During the first fifteen (15) years of original ownership, if the mattress is deemed defective, Nolah Sleep LLC shall be responsible for the repair or replacement and shipping costs associated with repair or replacement.

From years fifteen (15) we will, at our option, repair the mattress at a handling cost to the original owner, or replace the mattress at a prorated charge to the original owner plus $75 shipping cost. If we replace the mattress, the prorated replacement charge will depend on when the mattress is replaced.

1. If the mattress is replaced during the fifteenth (15) year and twenty-fifth (25) year of this warranty, the original owner will pay the prorated replacement charge of fifty (50) percent of the original purchase price.

2. If the mattress is replaced after the twenty-fifth year of this warranty, the original owner will pay the prorated replacement charge of sixty (60) percent of the original purchase price.

Non-Transferable. The Limited Warranty is only valid for the original purchaser and only for an Original or Signature Nolah Mattress sold by Nolah Sleep. The Limited Warranty is non-transferable and not valid for any additional owners of the Nolah Mattress.

Requirements to Return Under the Limited Warranty. Only Nolah Mattresses which meet the following requirements will be replaced or repaired under the Limited Warranty:

The Nolah Mattress – if used correctly on a supportive and proper foundation/base which is substantial enough to support the mattress and its users – must only show normal deterioration, which is defined as having visible indentations of less than one and a half inch (1.5”);

The Nolah Mattress must not show any physical damage to the foam caused by craftsmanship of the mattress in consistent with normal deterioration.

The Nolah Mattress-cover must not show craftsmanship defects including seams and zipper. If a Nolah Mattress-cover is deemed defected Nolah may choose to repair or replace it. If the cover is replaced, it will be with the current design, which may be a different material, color or style than the original cover purchased. The outer cover is warranted for one (1) year from the date of original purchase against faults in material or craftsmanship.

Items that are Not Covered. The Limited Warranty does not cover the following:

Damage for failure to use a proper bed frame, including, but not limited to, damage caused by an adjustable frame, improper foundation, and/or platform bed;

A normal increase in softness of the foam which is normal and does not affect the pressure-relieving quality of the mattress.

Indentions in the foam less than one and a half inch (1.5”).

Comfort preference over time

Physical abuse or damage to the Nolah Mattress and/or cover material, including, but not limited to, burns, cuts, infestation, damped, liquid damage, soiling, stains, and/or tears; and/or

Repair and/or replacement of the seams, zipper assembly, or mattress cover

Faults in cosmetic appearance on the cover such as wrinkles, normal wear and tear and naturally occurring blemishes on the cover

When using the Nolah products for any commercial use such as rental properties, hotels, schools, AirBnb, Bed & Breakfast, etc.

Original Purchaser. The Limited Warranty is only available to the original purchaser who purchases a Nolah Mattress from an authorized reseller or through the Site. The Limited Warranty does not cover any purchases of Nolah Mattresses from unauthorized resellers and/or any Nolah Mattress that is sold “as-is”, “preconditioned”, “reconditioned”, “used”, “returned”, “previously owned”, or any other similar wording indicating that the Nolah Mattress is not “new” or of “first quality”. Any purchases of a Nolah Mattress from an original purchaser will not be covered under the Limited Warranty

Product Replacement Terms. Except as otherwise provided herein, Nolah Sleep will not charge you to repair or replace your Nolah Mattress if it is covered under the Limited Warranty except for a $75 one way shipping fee. Nolah Sleep must arrange the shipping, and the mattress must be deemed to be covered under warranty. If the mattress is considered not to be covered under warranty, the original purchaser will be responsible for all shipping costs. Nolah Sleep must in all circumstances arrange the shipping.

Warranty on Replacement Products. No new Limited Warranty is provided on any replacement Nolah Mattresses. The Limited Warranty for the replacement Nolah Mattress only runs from the date of purchase of the original Nolah Mattress and will expire ten years from then.

NOLAH PILLOWS

Your new Nolah pillow is covered by a two (2) year limited warranty.

Warranty term Nolah Pillows. Defects due to faulty workmanship or materials.

NOLAH ADJUSTABLE BASES

Limited ten (10) year warranty.

Non-Transferable. The Limited Warranty is only valid for the original purchaser and only for a Nolah Adjustable Base sold by Nolah Sleep LLC. The Limited Warranty is non-transferable and not valid for any additional owners of the Nolah Mattress.

Full 1-year warranty:

The Adjustable bed is warranted against any defects in materials or workmanship for a period of one year from the date of purchase to the original purchaser. During the first year, Nolah Sleep will repair or replace, at no cost to the original purchaser, any defective part. This includes all authorized labor and transportation costs incurred with the repair or replacement of any parts found to be defective.

2-year motor warranty:

The adjustable bed has a two-year, full replacement warranty, parts, labor, and transportation; on the motor, should the motor(s) fail during the first two years of this warranty from the original purchase date,

5-year warranty:

During year two through five, from the original purchase date, Nolah Sleep will replace any bed part, to the original purchaser, found to be defective. The part must be returned within fourteen (14) days of receipt of the replacement part(s), or purchaser may be subject to charges for said part(s) to include, but not limited to freight charges. Liability of Nolah Sleep is limited to the replacement of the defective part or parts ONLY with purchaser responsibility for all service, installation and transportation costs of said part(s)

10-year limited warranty:

From year six to ten from the original purchase date, Nolah Sleep will replace, per the terms and conditions set forth in this paragraph, any bed part found to be defective. Purchaser shall pay 1/180 of the current replacement cost of the defective part multiplied by the number of months, after the fifth (5th) year, from the original purchase date. This warranty applies only to replacement parts. The purchaser may be subject to charges for said part(s) to include, but not limited to, freight charges. Liability of Nolah Sleep shall be limited to the replacement of the defective part(s) only with purchaser responsibility for all service, installation and freight costs of the said part(s).

Additional terms and conditions:

Warranty does not include reimbursement for inconvenience, removal, installation, set up, loss of use, shipping, or any other costs or expenses not expressly covered in this warranty. This warranty does not apply:

To damage resulting from misuse or abuse caused by the purchaser

To damage caused by the repairs or parts replacement by an authorized person.

If the adjustable bed has been mishandled (including during shipping), subject to physical abuse or an improper power supply, or otherwise operated in a manner inconsistent with procedures outlined in the owner’s manual and warranty explained on this site.

To damage to mattresses, bedding, cables, electrical cords, or accessories supplied by dealers.

To modification of the bed without prior written consent by Nolah Sleep.

To costs for unauthorized service calls for the purpose of educating the consumer about the bed or locating properly functioning power outlets.

If the recommended weight restrictions are exceeded.

If used in an environment or a commercial setting for which it was not intended. Although your bed has been rigorously tested within all recommended limits, to maintain the highest standards, exceeding the recommended weight limits may void your warranty. The recommended weight restrictions are 500 lbs, and is calculated to include the weight of the mattress,

Some states do not allow the exclusions of incidental or consequential damages; therefore, the above limitation or exclusion may not apply. This warranty gives the purchaser specific legal rights. The buyer might have other privileges, which may differ based on where they live. This warranty is valid in the 48 continuous states.

Original Purchaser. The Limited Warranty is only available to the original purchaser who purchases a Nolah Adjustable base from an authorized reseller or through the Site.
